Agreement to Terms

By accessing or using Vision CRM's services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

Description of Service

Vision CRM provides a cloud-based customer relationship management platform designed for real estate professionals. Our services include property management, client relationship tracking, sales pipeline management, and related tools to help you manage your real estate business.

Account Registration

To use our services, you must:

  • Be at least 18 years old and legally able to enter into contracts
  • Provide accurate, current, and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Be responsible for all activities that occur under your account

Subscription and Payment

Vision CRM offers subscription-based services with the following terms:

  • Subscriptions are billed in advance on a monthly or annual basis
  • You authorize us to charge your payment method for all fees
  • Fees are non-refundable except as required by law or stated in our refund policy
  • We may change pricing with 30 days' notice to existing subscribers
  • Failed payments may result in service suspension or termination

User Content and Data

You retain ownership of all content and data you upload to Vision CRM. By using our services, you grant us:

  • The right to store, process, and transmit your content to provide our services
  • Permission to use anonymized, aggregated data for analytics and service improvement
  • The ability to backup your data for disaster recovery purposes

You are responsible for maintaining backups of your data and ensuring you have the right to upload any content to our platform.

Acceptable Use

You agree not to:

  • Violate any laws or regulations in your use of our services
  • Upload malicious code, viruses, or other harmful content
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use our services to send spam or unsolicited communications
  • Reverse engineer, decompile, or disassemble our software
  • Use our services in any way that could damage, disable, or impair our systems
  • Resell or redistribute our services without authorization

Intellectual Property

Vision CRM and its original content, features, and functionality are owned by us and protected by international copyright, trademark, and other intellectual property laws. You may not use our trademarks, logos, or branding without our prior written consent.

Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access to our services. We may temporarily suspend access for maintenance, updates, or to address security issues. We are not liable for any loss or damage resulting from service interruptions.

Termination

You may cancel your subscription at any time through your account settings. We may suspend or terminate your access if you:

  • Violate these Terms of Service
  • Fail to pay required fees
  • Engage in fraudulent or illegal activities
  • Create risk or legal exposure for us or other users

Upon termination, your right to use our services ceases immediately. You may export your data within 30 days of termination, after which we may delete your account and data.

Disclaimers and Limitations

Our services are provided "as is" and "as available" without warranties of any kind. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

Indemnification

You agree to indemnify and hold harmless Vision CRM, its affiliates, and their respective officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of our services or violation of these terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in San Francisco County, California.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated terms on our website and updating the "Last updated" date. Your continued use of our services after such changes constitutes acceptance of the updated terms.
